1. Agreement to Terms

By accessing and using Project Designer, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. License & Usage Rights

Project Designer grants you a limited, non-exclusive, revocable license to use this service for curriculum planning in an IB Design programme.

You may NOT:

Reproduce, modify, distribute, or sell the service
Reverse-engineer or attempt to gain unauthorized access
Use the service for commercial purposes without a School plan
Share your account credentials with others
Scrape, crawl, or automate data collection

3. User Responsibilities

You are responsible for maintaining the confidentiality of your account credentials
You must be 18+ or have parental consent (for students)
You must provide accurate, current information
You are liable for all activity on your account
You must comply with all applicable laws and regulations

4. School Account Obligations

If you purchase a School plan, you (the school administrator) agree to:

Manage user access and enforce safeguarding policies
Ensure compliance with student privacy laws (FERPA, GDPR)
Monitor student activity and address inappropriate content
Provide consent forms and parent approvals (where required)
Enforce data retention policies

5. Acceptable Use Policy

You agree NOT to use Project Designer for:

Harassment, bullying, or threatening behavior
Hate speech or discrimination
Sexual or abusive content involving minors
Distribution of malware or viruses
Phishing, fraud, or impersonation
Violating intellectual property rights

Violations may result in account suspension or legal action.

6. Payment & Billing

Monthly and annual billing available; auto-renewal applies
You can cancel anytime; refunds only for unused portions
Payment processed via Stripe; see Stripe terms for details
We reserve the right to change pricing with 30 days' notice

7. Limitation of Liability

Project Designer is provided "as is" without warranties. To the fullest extent permitted by law, we are not liable for:

Indirect, incidental, or consequential damages
Loss of data, revenue, or business
Service interruptions or downtime
Third-party actions or content

8. Termination

We may suspend or terminate your account if you violate these terms or engage in illegal activity. Termination is effective immediately.

On termination, school-controlled data will be returned or deleted in accordance with the applicable agreement, verified school instructions, legal obligations and the hosting provider's backup lifecycle.

9. Changes to Terms

We may update these terms at any time. Continued use of the service after changes constitutes acceptance.

10. Governing Law

These terms are governed by Swiss law. Any disputes shall be resolved in Swiss courts.
